It's uncertain if the Texas Abortion ban will lead to the cancellation of same-sex marriage in the state, but it's a possibility. Many are questioning how this new law might affect the future of same-sex marriage and legal unions for all Americans. Let me share what I know so far.
The Supreme Court ruled in favor of marriage equality in 2015 following Obergefell v Hodges. However, there were marriage equality bans in place all over the country - Texas being one such place.
Now a Texan legislator is asking that the state ban overrides the Supreme Court’s decision.
The attack on abortion rights paved the way for dismantling other privacy rights in Texas.
Republican Rep. James White
Republican Rep. James White sent an open letter to Attorney General Ken Paxton asking him about the Supreme Court’s landmark marriage equality ruling and if it means Texans must recognize same-sex marriages when the state law still defines marriage as being between one man and one woman.
The Attorney General’s office has not yet responded. It should be noted that it has more or less 180 days to do so.
One argument White uses is that the Supreme Court doesn’t strike down laws, they just remain dormant.
Another argument put forward looks at the private sector.
White explains, “the fact that a federal district court has enjoined state officials from enforcing the Texas marriage laws in no way affects the existence or validity of those laws with regard to private parties, who are not even bound by the Fourteenth Amendment — let alone the Supreme Court’s purported interpretations of it.”
The major issue behind this demand is that it follows the same strategy as Texas’ recent abortion ban, which is now in the hands of the Supreme Court justices.
Is Texas’ equal marriage law in danger? The abortion ban has opened up an opportunity for assaults on equal rights so we can seriously question what will happen next.
